Clear terms and conditions for bookings, payments, and cancellations.For this booking, Happy Holiday Travels Ltd acts only as a booking agent and not as the tour operator, unless your confirmation invoice explicitly confirms that we are the organiser or principal for that booking.
These terms outline the basis upon which we handle your travel or holiday bookings. When finalising your booking, we'll coordinate for you to enter into an agreement with the principal travel supplier(s) (this could be a tour operator, airline, cruise company, or accommodation provider) as indicated on your receipt(s).
BOOKING TYPES
Package Holidays: A combination of at least two travel services for the same trip sold as a package, where the organiser named on your confirmation is responsible for the package.
Individual Services: Standalone travel services booked separately with different suppliers, creating separate contracts with each supplier.
ATOL
We are not an ATOL holder. Some flight or flight inclusive bookings may be arranged through an ATOL holder. Where ATOL protection applies, you will receive an ATOL Certificate issued by the relevant ATOL holder confirming what is protected and who is responsible. Not all travel services are covered by ATOL.
1. TERMS OF BUSINESS
1.1 These constitute the agency terms of business for Happy Holiday (“Agency Terms”). We act as an agent for Travel Suppliers (tour operators, airlines, cruise companies, accommodation providers, etc.). Except where explicitly stated, we do not act as principal. The terms and conditions of the Travel Suppliers apply to your booking.
1.2 A binding agreement will only exist once we receive the signed booking form and/or required payment and issue confirmation on behalf of the Travel Supplier.
1.3 The booking arrangement applies to the person signing the booking form (or paying the deposit where no form is required). That person accepts full responsibility.
1.4 Your booking is governed by:
- These Agency Terms and the Travel Supplier's booking conditions;
- The booking form (names must match passport details);
- The invoice;
- The itinerary (which may be subject to minimum participation requirements).
Your personal data will be processed in accordance with UK data protection law and shared only with relevant travel suppliers and authorities where required for your booking; where data is transferred outside the UK, it will be handled in line with applicable international transfer requirements.
2. PRICE
2.1 For package holidays, we (or the organiser) may revise the price only in line with the Package Travel and Linked Travel Arrangements Regulations 2018, and no later than 20 days before departure; you will be entitled to a price reduction where relevant costs fall, and you may cancel without charge if any increase exceeds 8%.
2.2 For package holidays, your statutory rights apply; for non package bookings, any price changes and remedies are subject to the relevant Travel Supplier’s terms.
2.3 For package holidays, we do not provide a breakdown of component costs.
3. PAYMENT
3.1 Bookings within 10 weeks of departure require full payment at booking.
3.2 Bookings made earlier require a deposit at booking and full balance at least 8 weeks before departure.
4. CHANGES TO BOOKINGS
4.1 Changes by You:
- Must be submitted in writing by the booking form signatory;
- Subject to Travel Supplier approval;
- Minimum £50 administration fee per person plus supplier charges.
4.2 Changes by Travel Suppliers:
If significant changes occur, you will be notified and remedies will follow the Travel Supplier’s terms.
5. CANCELLATION
5.1 Cancellation by You:
- Must be submitted in writing;
- Cancellation charges may apply up to 100% of booking cost.
5.2 Cancellation by Travel Suppliers:
Failure to pay on time may result in cancellation. Supplier terms will govern any additional cancellation circumstances.
6. LIABILITY
6.1 Your contract is with the Travel Supplier. Happy Holiday is not liable for their acts or omissions.
6.2 We are not liable for failures caused by you.
6.3 We are not liable for force majeure events including war, terrorism, natural disasters, technical failures, industrial disputes, or other unforeseen circumstances.
6.4 We are not liable for indirect, consequential, or economic losses.
6.5 Our maximum liability shall not exceed the total amount paid for the booking in question.
6.6 Visa assessment and application service fees are non-refundable once paid.
6.7 Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
7. COMPLAINTS PROCEDURE
If you have a complaint or issue, you must report it as soon as possible during travel to the relevant supplier and also notify us promptly so we can assist with escalation and resolution where appropriate.
8. APPLICABLE LAW AND JURISDICTION
All disputes are governed by English law and subject to the exclusive jurisdiction of the English courts.
9. ADDITIONAL BOOKING DETAILS
9.1 Insurance: Comprehensive travel insurance is strongly recommended.
9.2 Passport, Visa & Health Requirements: You are responsible for compliance with all passport, visa and health requirements.
9.3 Pre-Departure Checklist: Ensure all documents are valid and allow sufficient airport check-in time.
